Privacy Policy

Nourish to Conceive Pty. Ltd. (ABN 19 691 048 138) is run by Kylie Heard, Fertility Nutritionist & Coach, in Hervey Bay, Queensland. In this policy, “I” and “me” mean Kylie and the company.

This policy explains what personal information I collect, why I collect it, how I look after it and what your rights are. I handle personal information in line with the Privacy Act 1988 and the Australian Privacy Principles.

1. What I collect

  • Contact details: your name, email address and phone number.
  • Email list details: your first name and email address, if you sign up for my emails.
  • Health information: what you tell me about your health and fertility. This can include your medical and reproductive history, diagnoses, fertility treatment, menstrual cycle, medications and supplements you take, symptoms, eating habits, lifestyle, and test results you choose to share.
  • Microbiome test results: only if you choose a package that includes testing.
  • Session notes and plans: the notes I make during our work together and the nutrition plan I prepare for you.
  • Payment records: what you bought and when. I do not see or store your full card number.
  • Messages: anything you send me by email, website form or social media.

Health information is sensitive information under the Privacy Act. I only collect it with your consent and only what I need to support you.

2. How I collect it

I collect information directly from you: when you fill in a form on this website, sign up for my emails, book or attend a discovery call, complete an intake form, email me, or talk with me in a session. Sessions are held online using Zoom. I do not record sessions unless we both agree beforehand.

If you would rather not share some information, that is your choice. It may limit how well I can tailor my advice.

3. Why I collect it and how I use it

I use your information to:

  • provide nutrition education and coaching that fits your situation
  • prepare and update your nutrition plan
  • contact you about bookings, sessions and your program
  • take payment and keep business records
  • answer your questions
  • send you my fertility nutrition emails, if you have signed up for them
  • meet my legal and insurance obligations.

I do not sell your information or share it with advertisers. I do not use automated decision-making.

I only send marketing emails to people who have signed up for them. These emails share fertility nutrition information and may mention my services. Every email has an unsubscribe link, and you can also email me to be removed from the list.

4. Who I share it with

I do not share your health information with anyone unless you ask me to, for example if you want me to write to your GP or fertility specialist, or unless the law requires it.

Some trusted service providers handle information for me so that I can run the business:

  • Webador, which hosts this website, its contact forms, its shop and my info@nourish-to-conceive.com mailbox
  • Zoom, for video calls and bookings
  • Microsoft, for email
  • MailerLite, for my email list and the emails I send to subscribers
  • Stripe, for payments
  • Google, for spam protection on the contact forms
  • Apple, for iCloud backup of my documents
  • i-screen, if you choose a package that includes testing.

I may use your words or photo as a testimonial only with your written permission, and you can withdraw that permission at any time.

5. Where your information is kept

Your information is kept in my business email account and in documents on my password-protected laptop, which are backed up to Apple iCloud. My email account uses two-step verification.

Some of the providers listed above store information outside Australia. This is likely to include the Netherlands and other European Union countries (Webador and MailerLite) and the United States (Zoom, Microsoft, Stripe, Google and Apple). i-screen is an Australian company.

6. How long I keep it and how I protect it

I keep client records for seven years after our last contact, then delete them securely. Enquiries that do not become client work are deleted after 12 months. If you join my email list, I keep your name and email address until you unsubscribe or ask me to remove them.

I take reasonable steps to protect your information from misuse, loss and unauthorised access. No system is perfectly secure. If a data breach is likely to cause you serious harm, I will tell you and the Office of the Australian Information Commissioner as the law requires.

7. Seeing or correcting your information

You can ask for a copy of the information I hold about you, or ask me to correct it, by emailing me. I will respond within 30 days. There is no charge for asking.

8. This website

This website is hosted by Webador. It counts visits using Plausible, an analytics tool that does not use cookies or identify you. The contact forms use Google reCAPTCHA to block spam, which sends some information about your device to Google. The email sign-up form is provided by MailerLite, which also records whether my emails are opened and which links are clicked, so I can see what is useful. The shop may use essential cookies to remember your cart. The site links to other websites, such as Zoom, Facebook and Instagram. Their privacy policies apply once you leave this site.

My services are for adults aged 18 and over.

9. Complaints

If you are unhappy with how I have handled your information, please email me first so I can put it right. I will respond within 30 days.

If you are not satisfied with my response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

10. Changes to this policy

I may update this policy from time to time. The latest version will always be on this page, with the date at the top.
